By accessing or using AshParX's mobile applications, websites, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Services.

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. AshParX reserves the right to modify or discontinue, temporarily or permanently, the Services with or without notice.

To use our Services, you must:

• Have the legal capacity to enter into a binding agreement
• Not be prohibited from receiving our Services under applicable laws

Subject to your compliance with these Terms, AshParX grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install our mobile applications on your personal devices
• Use the features and functionalities as intended

4.1 Restrictions

You may not:

• Copy, modify, or create derivative works of the Services
• Reverse engineer, decompile, or disassemble any part of the Services

"User Content" means any content that users submit, post, display, or otherwise make available through the Services.

5.1 Your Responsibilities

You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content in connection with operating and providing the Services.

5.2 Content Guidelines

You are solely responsible for your User Content and its legality, reliability, and appropriateness. By posting User Content, you represent that:

• You own or have the necessary rights to the content
• The content does not violate any third-party rights
• The content is not unlawful, harmful, or offensive
• The content does not contain viruses or malicious code

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable in our sole discretion.

You agree not to use the Services:

• For the purpose of exploiting, harming, or attempting to exploit or harm minors

• To impersonate or attempt to impersonate AshParX, employees, or other users

• To interfere with or disrupt the integrity or performance of the Services
• To attempt to gain unauthorized access to any part of the Services

The Services and their original content (excluding User Content), features, and functionality are and will remain the exclusive property of AshParX and its licensors.

• Software, code, and algorithms
• Graphics, logos, and designs
• Documentation and materials
• Trademarks and service marks
• Patentable inventions

7.2 Open Source Components

Some components of our Services may be subject to open source licenses. Such components are licensed under their respective open source licenses, not these Terms.

7.3 Feedback

Any feedback, comments, or suggestions you provide regarding the Services is entirely voluntary. We may use such feedback without any obligation to you.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8.1 Upon Termination

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

8.2 Survival

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ASHPARX MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICES, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, ASHPARX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ASHPARX DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ASHPARX, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
• ANY CONTENT OBTAINED FROM THE SERVICES
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL ASHPARX'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT OF ONE HUNDRED INDIAN RUPEES (₹100).

You agree to defend, indemnify, and hold harmless AshParX and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the Services
• A breach of these Terms
• Your violation of any third-party right
• Any claim that your User Content caused damage to a third party
• Your violation of any applicable law or regulation

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.1 Jurisdiction

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Betul, Madhya Pradesh, India.

12.2 Dispute Resolution

Before resorting to litigation, we encourage you to contact us first to attempt to resolve any dispute amicably.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.
